Legal Rights for Unmarried Couples in the UK
Many people are surprised to learn that unmarried couples in the UK do not have the same legal rights as married couples or those in a civil partnership.
There is no such thing as a “common law marriage” in UK law, even if a couple has lived together for many years.
This can come as a shock when a relationship ends or if one partner passes away.
For unmarried couples, legal rights often depend on whose name is on the property, bank accounts, or other assets. If a couple separates, there is no automatic right to financial support or a share of property unless ownership or contributions can be clearly shown. This can lead to disputes, especially where one person has paid towards a home that is not in their name.
When children are involved, both parents still have responsibilities, regardless of marital status. Child arrangements and financial support are dealt with separately from the parents’ relationship. Unmarried partners may also have limited inheritance rights unless a will is in place.
Understanding these differences is important for protecting yourself. Legal advice can help clarify your position, especially when buying property together, separating, or planning for the future.
