ILR Eligibility Requirements Explained UK
People often ask, “When can I apply for ILR?”
The honest answer is: it depends on the route you’re on.
Common ILR routes include:
- Spouse / partner route (usually after 5 years)
- Skilled Worker route (usually after 5 years)
- Long residence route (usually after 10 years)
- Some other routes with different time periods
But time alone is not enough.
The Home Office also checks:
- Have you stayed within the rules of your visa?
- Have you spent too much time outside the UK?
- Do you meet the English and Life in the UK requirements?
- Do you have any criminal issues or immigration breaches?
This is where people get caught out. They think, “I’ve been here 5 years, so I’m fine.” Then the Home Office finds gaps or absences.
