How to Gather Evidence for Family Court Cases
Gathering evidence for a family court case can feel overwhelming, but good preparation makes a big difference.
The first step is to understand what the court is being asked to decide.
This could involve children, finances, or contact arrangements.
Once you know the issue, you can focus on evidence that is relevant, rather than trying to include everything.
Written records are often very important. This can include emails, text messages, letters, or messages that show communication between you and the other person. Keep them organised and in date order. If the case involves children, things like school reports, attendance records, or letters from teachers or professionals can be helpful.
For financial cases, bank statements, payslips, mortgage details, and bills are usually needed. Witness statements can also play a role. These are written statements from people who know the situation well, such as family members or professionals, but they should stick to facts rather than opinions.
Photos can sometimes be used, but only if they clearly relate to the issue being discussed. It is important to be honest and clear. Do not exaggerate or include information that is not relevant, as this can weaken your case. Keeping evidence tidy, labelled, and easy to follow helps the judge understand your situation and make a fair decision.
